§ 130.01. Consuming alcoholic beverages in public places.

  • It shall be unlawful for any person to consume any alcoholic beverage on any highway, avenue, street, alley, sidewalk, public parking lot, parking lot open to public use, public equestrian trail, and pedestrian walkway open to public use; provided, however, the provisions of this section shall not apply to the consumption by persons in the areas designated in this section of any duly prescribed and dispensed medication having alcoholic content; and provided, further, this section shall not be applicable in those areas and during such times as the Council has granted permission for the temporary use or occupancy of the public streets and areas appurtenant thereto. The provisions of this section shall not be deemed to make punishable any act which is prohibited by any law of the state.
